Terms of Service

These Terms of Service constitute a legally binding agreement between you ('User', 'Host', 'Creator', or 'Participant') and Pelican Fleet ERP Cloud Services ('Zomee', 'we', 'our', or 'us'). By accessing, creating, or interacting with any service through the Zomee ecosystem (including Video Meetings, Zomee Forms, MyHomeTree, and MyCard Studio), you signify your full agreement to these Terms, our Privacy Charter, and Acceptable Use Guidelines. If you do not agree with any provision of these Terms, you must cease using the platform immediately.

Zomee provides a unified cloud software suite consisting of four specialized applications: • Zomee Video Meetings: Browser-based ultra HD real-time video conferences, LiveKit WebRTC edge relays, screen share studios, collaborative whiteboards, audio-only podcast mode, and speech intelligence. • Zomee Forms & Intelligent Surveys: Dynamic form builder supporting text, multi-choice, rating, and file upload fields, response analytics, and automated notification dispatches. • Zomee Tree (MyHomeTree): Centralized creator bio-link hub showcasing meeting lobbies, published forms, and social channels with zero-login public sharing. • Zomee MyCard Cinematic Studio: Digital greeting studio creating video story reels and realistic unboxing greeting cards with scheduled email delivery, voice notes, and photo memories. Subject to compliance with these Terms, Zomee grants you a revocable, non-exclusive, non-transferable worldwide license to utilize these services for professional, educational, commercial, or personal communication.

Meeting creators ('Hosts') maintain complete administrative authority over their individual sessions: • Admission & Screening: Hosts have the right to enforce waiting rooms, require 4-digit security PINs, and admit or deny attendees at their sole discretion. • In-Meeting Controls: Hosts are empowered to mute participant microphones, disable cameras, disconnect disruptive attendees, and restrict attendee screen sharing. • Screen Share & Annotations: The host and approved presenters may share desktop screens, browser tabs, or app windows. Annotations drawn on-screen are synchronized in real-time. • Recording & AI Notification: The host is solely responsible for ensuring that all session participants are duly informed if local recording or AI transcription is active, in strict compliance with applicable two-party or all-party consent laws in their jurisdiction.

• Form Creator Responsibilities: Users who create and publish forms ('Form Creators') are solely responsible for the content, questions, and lawful basis for collecting respondent data. Forms requesting unlawful, sensitive financial, or illicit credentials are strictly prohibited. • Respondent Protection & Consent: Form Creators must provide adequate privacy disclosures to respondents. Zomee stores responses securely in encrypted cloud collections and never sells or repurposes respondent submission data. • Response Storage & Export: Form Creators can view, analyze, and export submitted responses to CSV or Excel at any time through their private dashboard.

• Public Link Availability: MyHomeTree profiles (zomee.app/myhometree/username) are publicly viewable by anyone on the web without requiring account registration or login. • User Responsibility for Outbound Links: You are solely responsible for all external links, URLs, social profiles, and branding published on your tree. Linking to malware, phishing domains, prohibited content, or copyright-infringing material will result in immediate suspension. • Vanity Handle Reservation: Handles are granted on a first-come, first-served basis. Zomee reserves the right to reclaim handles that infringe registered trademarks or engage in username squatting.

• Greeting Card Creation & Content: Creators can design cards featuring custom greetings, photos, voice recordings, and video clips. Creators warrant that all uploaded multimedia content complies with copyright and privacy laws. • Scheduled Email Delivery: When scheduling greeting cards via email, Zomee automated dispatch queues process delivery at the designated date and time. While we maintain a 99.8% inbox delivery rate, Zomee is not liable for delays caused by recipient email spam filters or invalid email addresses. • Recipient Interactions & Reactions: Recipients can view the card or video story reel without logging in and send emoji reactions back to the creator. Card access links are private tokens unique to each card.

• Subscription Plans: Zomee offers a free tier (with 60-minute meeting limits) and Zomee Pro passes (providing 4-hour uninterrupted sessions, AI recaps, cloud vault, custom vanity URLs, and full access to Pro app features). • Multi-Gateway Secure Processing: All Pro purchases are processed securely in real time through Stripe, PayPal, LemonSqueezy, Apple Pay, Google Pay, or certified credit card gateways. Full tax invoices with downloadable PDF receipts are dispatched to the customer's email immediately upon charge authorization. • 1-Year Auto-Renewal Policy: The 1-Year Annual Pass is active for 365 days from the moment of purchase. To guarantee uninterrupted service, subscriptions auto-renew at the conclusion of the 1-year billing cycle at the active rate unless cancelled prior to the renewal date. If cancelled or if automatic payment cannot be authorized, the account transitions to the standard free tier without penalty or data loss.

Users agree NOT to use any Zomee service to: • Transmit unlawful, defamatory, obscene, harassing, abusive, or infringing content. • Interfere with or disrupt the integrity, security, or performance of WebRTC signaling servers, SFU edge relays, or database backends. • Deploy automated bots, screen-scrapers, or unauthorized crawlers without express written permission. • Distribute computer viruses, ransomware, malicious code, or conduct phishing and social engineering attacks. Violations of this section will result in immediate account termination, IP banning, and potential legal prosecution.

You retain full, exclusive ownership of all intellectual property, materials, audio streams, video presentations, documents, form submissions, and chat logs transmitted across any Zomee application. Zomee does not claim any ownership, copyright, or intellectual property rights over user content. By transmitting data through our relays, you grant Zomee only the temporary technical permission necessary to transmit and route media packets to intended recipients.

• 99.9% Uptime SLA: We strive to maintain 99.9% network availability across our global WebRTC edge relays and app servers. Scheduled maintenance is performed during off-peak hours with advance notice. • Disclaimer of Warranties: Except as expressly provided, the services are provided 'AS IS' and 'AS AVAILABLE'. Zomee disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that sessions will be completely error-free or uninterrupted across third-party internet service providers (ISPs).

These Terms are governed by and construed in accordance with the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates. Any dispute arising out of or in connection with these Terms shall be resolved through friendly consultation or submitted to the exclusive jurisdiction of the competent courts of Dubai.
